PLEASE READ THESE TERMS AND CONDITIONS OF SALE CAREFULLY. THEY GOVERN YOUR PURCHASE OF OUR PRODUCTS AND CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS.

Acceptance of These Terms

You (“Customer”) may place orders for products (“Products”) with 9th Wave BV (“9th Wave Cycling”, “we”, “us”, “our”) via our website https://9thwave-cycling.com/ (“Website”). By placing an order, you agree to these terms and conditions of sale (“Terms”). These Terms apply to consumers. Business customers (dealers, OEM partners and other companies purchasing for resale or for use in their own products) are governed by our B2B Terms of Sale.

These Terms are available in multiple languages. In case of discrepancies between language versions, the English version prevails.

Changes to the Terms

We may revise these Terms to reflect changes to our Website, our business or the law. The version of the Terms in place at the time you placed your order applies to that order.

We are 9th Wave BV, a company registered in the Netherlands under Chamber of Commerce number 63396378, with our registered office at Prinsenweide 26, 7317 BB Apeldoorn, the Netherlands. Our VAT number is NL855217765B01. To contact us, please email [email protected] or see our contact page.

Delivery Area

We deliver to consumers worldwide. Because product liability rules in the United States differ fundamentally from the rules that apply to us in the Netherlands and the European Union, we do not deliver wheelsets or rims to consumers in the United States. Other Products may be delivered to the United States at our discretion. If an order for wheelsets or rims with a delivery address in the United States is nevertheless placed, we may cancel it and will refund any amount paid in full.

Products

The images of the Products on our Website are for illustrative purposes. Although we make every effort to display colours accurately, your screen may not show them exactly, and your Products may vary slightly from the images.

Orders

You can place an order by following the order process on the Website, during which you can identify and correct any input errors. The agreement is concluded when we confirm your order by email. We may refuse an order before it has been confirmed.

After confirmation we may cancel an order if the Product turns out to be unavailable, in case of an obvious pricing error (see Price), if payment is not received or cannot be verified, or if we do not deliver the ordered Product to the delivery address. In that case we will inform you as soon as possible and refund any amount paid in full.

Price

All prices on the Website are subject to change, but changes do not affect confirmed orders.

Despite our efforts, a Product may occasionally be priced incorrectly. If we discover an error, we will inform you and give you the choice of continuing your purchase at the correct price or cancelling the order. If the pricing error is obvious and could reasonably have been recognised by you as a mistake, we are not obliged to supply the Product at the incorrect price.

VAT

For consumers within the European Union, prices on the Website include VAT. If the VAT rate changes between the date of your order and the date of delivery, we will adjust the VAT, unless you have already paid in full before the change took effect.

For consumers outside the European Union, prices are shown excluding VAT. You are responsible for any import VAT, duties and charges in your country.

Payment

You pay using one of the payment methods offered on the Website. Orders are paid in full directly after order confirmation and before shipment. Shipment is subject to verification of the payment.

Delivery

Delivery costs and any delivery restrictions are shown during the order process. Delivery times are good-faith estimates; we will deliver within 30 days at the latest unless a longer delivery time has been agreed. Ownership of, and risk for, the Products pass to you upon delivery.

Invoice

With the dispatch of your order, you will receive an invoice by email. Please keep your invoice: the invoice date is the start date of the warranty period.

Right of Withdrawal

As a consumer in the European Union you have the right to withdraw from your purchase without giving a reason within 14 days after you, or a third party designated by you other than the carrier, received the Product.

During this period you may handle the Product only as far as reasonably necessary to assess its nature, characteristics and functioning, as you would in a shop. This does not include mounting tyres, using sealant or riding the wheels. Products must be returned unused, complete and, where possible, in their original packaging. If you have handled the Product beyond what was necessary, or if it is returned damaged or incomplete, we may charge you for the reduction in value.

To withdraw, notify us within the withdrawal period through our service request page or by email. We will then confirm how to return the Product. Return the Product within 14 days after your notification. You bear the direct costs of returning the Product and the risk until we have received it. A return shipping label arranged by us is available on request, for a fee that is deducted from your refund. We will refund the purchase price, including the standard delivery costs, within 14 days after receiving your notification, but we may wait until we have received the Product back or you have shown proof of return.

Exception: the right of withdrawal does not apply to Products made to your specifications or clearly personalised, such as wheels built with colours, decals or wheel configurations that deviate from our standard options.

Product Changes

We may change the design or specifications of a Product if this is necessary or desirable to improve its safety or performance, or if components are unavailable from our suppliers, provided that the change does not reduce the quality or function of the Product you ordered. If a change is significant, we will contact you first and you may cancel your order free of charge.

Warranty

You are entitled to the statutory rights that apply to consumer purchases. In addition, 9th Wave grants a 2-year warranty from the invoice date. This warranty does not limit your statutory rights. The scope, conditions and exclusions of our warranty and extended warranty are described in our warranty policy.

Installation and Use

Our Products must be installed by a qualified bicycle mechanic, according to our instructions and with compatible components, and used within the specifications published on the Product page and our support pages, including the maximum combined weight of rider, bike and luggage, the recommended tyre sizes and pressures, and the intended discipline. We are not responsible for damage caused by incorrect installation or use, incompatible components, use outside these specifications, modifications, crashes or normal wear.

Liability

We are only responsible for our own Products. We are not liable for third-party parts such as tyres, tubes, sealant, cassettes, brake rotors, frames or other bicycle components, or for the work of third-party mechanics.

To the fullest extent permitted by law, we are not liable for indirect or consequential damage, including lost profit, loss of use, event, travel or replacement costs and medical costs. Our total liability for any damage is limited to the purchase price of the Product concerned.

Liability that cannot be excluded or limited under mandatory law remains unaffected.

AI Support Assistant

The AI features on our Website are designed to help you quickly with product advice, information and general assistance. Although we strive to keep this technology accurate and reliable, AI-generated information may occasionally be incomplete, outdated or incorrect, and we cannot guarantee its accuracy. If in doubt, please contact our customer service for personal and expert advice. AI-generated answers do not change these Terms.

Force Majeure

We are not responsible for delays or failure to deliver caused by circumstances beyond our reasonable control, such as strikes, war, natural disasters, epidemics or supplier failures. In that case we will perform our obligations as soon as reasonably possible. If delivery becomes impossible, you may cancel the order and we will refund any amount paid.

Complaints and Disputes

If you have a complaint, please contact us first at [email protected]. We aim to respond within 14 days.

These Terms and all agreements with 9th Wave are governed by Dutch law.

Transfer

We may transfer our rights and obligations under these Terms to another organisation, but this will not affect your rights or our obligations under these Terms.

Severability

Each paragraph of these Terms operates separately. If a court or authority decides that any of them is unlawful or unenforceable, the remaining paragraphs remain in full force and effect.

Waiver

If we do not insist on or delay enforcing any obligation under these Terms, this does not mean that we have waived our rights. A waiver is only valid if given in writing and applies only to that specific case.
